RESALE PACKAGE

 

The resale package started in July 2006 and will affect all future home sales.

This idea was proposed by the lawyer as a potential solution for meeting two needs of the association.

                    1.) Keep all residents dues low (currently only $120.00 per year).

                    2.) Provide notice in writing to prospective buyers as to the status of compliance with the HOA Bylaws.

The resale package costs $75.00 and includes a physical inspection of the home exterior for verifying compliance with the Association Bylaws. A letter of certification will be issued if the inspection has passed and a copy of the Bylaws will also be provided if it is needed.

To request a resale package, the home owner needs to simply mail a letter with the $75.00 payment to:

Any requests from Real Estate agents and Title Companies will be returned with an explanation of what is required to obtain a letter of certification.

If improvements were made to the home without the associations prior approval, then it will be necessary to submit a listing of the improvements in order to receive approval for the changes. (Regardless of whether or not the improvements fall within the Bylaws, the inspection will fail without the Architectural Committee receiving written notices for each of the improvements that have been made).

The Architectural committee maintains records of all approvals given and will have a list when the inspector arrives. If the improvements are not listed, then the home will fail the inspection.

Once the request for a letter of certification is received, including the $75.00 fee, the inspection will be initiated (within two weeks) upon receipt of the request.

As soon as it has been verified that all of the requirements have been met, a letter will be sent to the property owner. If requested, a letter will also be sent to the Real Estate agent and/or Title Company.

The letter of certification is good for three months and can be extended if needed for an additional three months. After six months from the date of the letter, then a new resale package will need to be obtained. If the inspection has failed, or money is owed, a letter will be sent explaining the problem. If the home fails inspection due to improvements that do not fall within the Bylaws, those improvements will have to be corrected, then the home re-inspected.

Note: There will be an additional $25.00 charge for each inspection needed.

Not having approvals for improvements will result in a failed inspection. If all improvements do fall within the Bylaws, a re-inspection will not be required, however the letter of certification may be held at the discretion of the Architectural Committee pending completion of the proper approval process.

This process will not stop the sale or purchase of the home, however if the home is still failing the inspection process, then the new buyer will be informed of the infractions and must accept the responsibility and costs associated with the necessary inspections and for restoring the home into compliance with the Association Bylaws.

- Obtaining approval from the Architectural Committee for improvements made to your home is a requirement and this process will ensure that it can not and will not be disregarded, bypassed or avoided in any way. There are no exceptions to this policy. -
