FINES
First off, a disclaimer is necessary - The Homeowners Association recognizes that due to situations beyond a persons control, it is sometimes necessary to "break the rules". We (the board) are willing to work with anyone that has an issue that will cause a violation. It is asked that an email or letter be sent at the first opportunity explaining the situation and a method that the board may use as a means to contact you. If this is not done, there are a few procedural steps that the board will pursue to ensure compliance with the Association Bylaws. They are:
Step One: Provide a complimentary letter to the homeowner advising them of the violation and a deadline that they must have the issue resolved by. (deadlines vary based on the situation and exceptions can be made by the board)
Step Two: Begin the official documentation process by providing a certified letter to the homeowner with another deadline.
Step Three: A $50.00 fine will be imposed upon the homeowner for failure to comply and a third deadline will be issued.
Step Four: A maintenance company will be hired to resolve the issue and the homeowner will be held responsible for covering the financial costs that are incurred.
Step Five: If the violation is flagrantly disregarded, habitually repeated or outside the scope of the maintenance company then the lawyer will be contacted for advising additional avenues to pursue which may include placing a lien against the home or even pursuing eviction if necessary.
